Tax Rates for Operators and Players in New York

When New York State's online sports bet platforms launched in January 2022, the operators were liable for a 51% tax on their gross revenue. Only Rhode Island and New Jersey pay the same percentage. Every other state levies much lower taxes. Iowa and Nevada pay the lowest rate of 6.75%. Maryland and Illinois both pay 15%. A majority of states, including Arizona and Ohio, pay 10%.

Operators are taxed on their Gross Gaming Revenue (GGR). This is based on the money generated by bets after bettors' winnings have been paid. However, this figure isn't entirely accurate as it also includes promotional bets that don't actually have a monetary value. For instance, operators earn no revenue at all from a bonus bet that loses, yet they are still taxed on the bet's supposed worth. Some states such as Pennsylvania and Michigan exclude promotional bets. In New York, all bets and promotional offers contribute to the operators' GGR.

Operators are also liable for federal taxation, which is currently at 0.25% of the total funds wagered. The operator generally retains a revenue of 5% for every $100 dollars that are wagered. They use this to pay expenses and taxes.

In New York, January 2022 was the first month of taking online sports bets. The GGR was $112,999,078 from an incoming total of $1,624,919,978. Federal taxes of 0.25% were $4,062,299.95. State taxes at 51% were calculated at $57,629,529,78. This may seem excessive when an estimated 30% of GGR is made up of promotional bets with no monetary value. The taxation paid in states such as Colorado and Virginia, excludes promotional bets.

In October 2021, New York's retail sports bets had a handle, or total money wagered, of $25,567,296. Once online platforms launched in January 2022, the handle increased to $1,686,263,898. It was the highest income from combined retail and online sport bets in the entire US. Taxes to be paid were $63,209,984. By comparison, Mississippi's handle was $66,523,295 with a tax bill of $782,567. The same month, Pennsylvania's bettors contributed $11,581,176 resulting in taxation of $782,567.

During the first week of January 2022, New York's sports bets online gained wagers of $314 million. However, some of New York's brand-new sites drew in more wagers than others. The top earner for the month was Caesars with $627,401,761. In second place was FanDuel with $517,492,498, followed by DraftKings who earned $377,952,846. BetRivers and Pointsbets collected wagers of $33,465,116 and $31,202,281 respectively.
